« La propriété intellectuelle ou le vol ! »... Tels semblent être les termes d'un débat qui fait rage autour de la contrefaçon de marques, de produits de luxe et de médicaments, ou du piratage de la musique, des films et des logiciels. Fondé sur des enquêtes de terrain et sur un suivi des meilleures analyses internationales, ce livre démonte ces fausses évidences, en montrant comment le régime actuel de propriété intellectuelle, en se renforçant et en s'universalisant depuis la fin de la guerre froide, est devenu un outil d'accumulation au profit de sociétés transnationales produisant ou sous-traitant des biens aisément duplicables (marques, médicaments, musiques, films, logiciels). La multiplication des droits de propriété intellectuelle en vient même parfois à entraver l'innovation qu'ils sont censés promouvoir. La révolution numérique en cours, dont l'impact historique est comparable à l'apparition de l'imprimerie, impose toutefois de sortir d'un modèle intégriste selon lequel la propriété intellectuelle serait l'unique ressort de l'innovation, et de réguler les nouveaux modèles émergents de création, d'innovation et de diffusion, de façon à concilier les intérêts des créateurs et des consommateurs, des pays industrialisés et des pays moins avancés, tout en utilisant au mieux les extraordinaires potentialités qu'offrent les nouvelles technologies de l'information et de la communication. "Intellectual property or theft! »... These seem to be the terms of a raging debate over the counterfeiting of brands, luxury goods and medicines, or the piracy of music, films and software. Based on field surveys and a follow-up of the best international analyses, this book dismantles these false evidences, showing how the current intellectual property regime, by strengthening and universalizing itself since the end of the Cold War, has become an accumulation tool for the benefit of transnational corporations producing or subcontracting easily duplicable goods (brands, medicines, music, films, software). The multiplication of intellectual property rights sometimes even hinders the innovation they are supposed to promote. The ongoing digital revolution, whose historical impact is comparable to the emergence of printing, however, requires us to move away from an fundamentalist model in which intellectual property is the sole springboard for innovation, and to regulate new emerging models of creation, innovation and diffusion, in order to reconcile the interests of creators and consumers, industrialized and less developed countries, while making the most of the extraordinary potential offered by the new information and communication technologies. |
